Purpose and scope of application

These sales conditions regulate access to and use of the BIKKOA® website, as well as the purchase of products through the online store. These conditions apply to all users who purchase sports glasses on the website.

What is BIKKOA?

BIKKOA is a Registered Trademark of SPORT NEEDS SL with CIF B67232520. 

User registration

To access as a registered user on Bikkoa and make any purchase, the registration form must be completed fully and truthfully. It is a mandatory requirement to be over 18 years old. It is strictly prohibited to include data of third parties, even with their consent. 

BIKKOA reserves the right not to accept or to delete false or incomplete registrations.

Contracting procedure

The procedure for making any purchase must follow the following phases:

  1. User registration: before making any commercial transaction, it is necessary to complete the registration form provided for this purpose. In this form, users can review the contracting conditions, as well as the legal notice and cookie policy regarding the use of the Website and the personal data provided throughout the process.

  2. Product selection: through the different available catalogs, users can select the desired product.

  3. Product acquisition / Start of the contracting process: once the product is selected, it will be added to the shopping cart. Users can review their purchase at any time in this section before making the payment. In this section, and prior to starting the commercial transaction, users must read and accept this document of general contracting conditions. Otherwise, the sale cannot be completed.

  4. Payment method selection: users can make the payment for the purchase through the methods provided on the purchase platform.

  5. Purchase confirmation: before contracting, users must accept the transaction and have agreed to the terms and conditions under which it is carried out. Once the purchase is made, the user will receive a confirmation email; otherwise, the Customer must contact BIKKOA via email. hola@bikkoa.com.

  6. Product shipment: the product will be sent within the deadlines indicated to the address provided by the user at the time of registration. For more information about shipping and delivery times, you can visit our link Shipping and Delivery Times.

BIKKOA informs you that for legal reasons it archives the electronic documents in which purchases are formalized. The consumer Customer, through the user channel, can access previously made purchases.
Contracts will be made exclusively in Spanish.

Prices

Once registered, users may purchase the offered items. Registration and acceptance of these conditions imply agreement with the product and its features and the price, expressed in euros.

The prices of the products available for sale on the website represent the final price with all taxes included, unless legally required otherwise, especially regarding VAT. Only shipping costs are excluded, which will be included at the time of purchase and always before the start of the commercial transaction.

Offers will be properly marked and identified as such, clearly indicating the previous price and the offer price.

BIKKOA reserves the right to make changes on the website at any time and without prior notice, updating products and services according to the market.

Withdrawal

The Customer has a period of 30 calendar days from the date of delivery of the purchased product to withdraw from the contract, without indicating the reasons for such decision, with the right to a full refund of all amounts paid, without any formalities other than proving it in any legally accepted manner, and without this implying any penalty other than the direct cost of returning the materials, if applicable.

To exercise this right, the Customer must notify BIKKOA of their decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by postal mail or email). For this purpose, they may use the model of withdrawal form which is attached as an Annex to these General Terms of Sale, although it is not mandatory, and may be sent later to the contact address shown on the invoice.

Once the withdrawal request has been received and processed, the amounts paid by the Customer will be refunded and documentary confirmation of this, as well as acceptance of the withdrawal request, will be sent to them.

Exceptions to the right of withdrawal

The right of withdrawal does not apply and therefore cannot be exercised once the product has been opened or unsealed, in accordance with the provisions of article 103 e) of Law 3/2014, of March 27, which amends the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text.

Warranty. Return of non-compliant products.

Despite our strict quality controls, for reasons beyond our control, you may receive an unwanted item, with a factory defect or in poor condition. BIKKOA is responsible for this under the terms established in consumer protection legislation.

According to this regulation, products have a two-year warranty from the delivery date. The consumer must report non-compliance within two months from when they became aware of it.

We kindly ask that as soon as you notice the product is non-compliant, you contact our customer service to report the issue.

BIKKOA is not responsible for negligent or improper use of the purchased product.

In case of a defective or damaged product, the consumer may choose repair or replacement, price reduction, or contract termination, provided the nature of the product allows the first option. Generally, our products only allow replacement. Our carrier will handle the collection of the defective product. It is essential to include a copy of the sales invoice.

Once the conditions for product replacement are verified, a new one will be sent to you without further delay. All procedures will be completely free for the consumer.

Claims related to defective products must be notified to us at the moment the defect is noticed by sending us a properly completed claim email to hola@bikkoa.com or by postal mail to the address shown at the end of that page. Shortly, we will send you a confirmation of the claim notification indicating the return address, in case the product must be returned, and any other necessary information if you have the right to return the product or products.

The notification you send us must include the following information:

  • order number of the defective product(s),

  • your name and contact information, and

  • a specification of the defective product(s) and the claimed defect.

Defective products will be refunded in accordance with current consumer protection legislation. In the case of a defective or damaged product, the consumer may choose repair or replacement, a price reduction, or contract termination, provided the nature of the product allows the first option. In general, our products only allow replacement.

We also reimburse any shipping costs resulting from the return of defective products. The refund will be made within thirty (30) days from the date of receipt of the returned shipment. The refund will be credited using the same payment method you used to make the payment, unless otherwise agreed.

If you believe that a purchased product is defective, but we do not agree, there is a conflict. To address such a conflict, if you purchased these products as a consumer, you may have the right to have the conflict evaluated by an alternative dispute resolution body. The alternative dispute resolution bodies that may be relevant to you are the following:

a) if you reside in the European Union, you can use the European Union online dispute resolution at http://ec.europa.eu/odr.

b) if you reside outside the European Union, you can use the above online dispute resolution or contact your local authorities.

Limitation of Liability

BIKKOA disclaims all liability in the following cases:

Bikkoa is not responsible for technical failures that, due to unforeseen or other causes, prevent the normal operation of the service via the internet, nor for the unavailability of the site due to maintenance or other reasons that prevent access to the service.

Reservation of Rights

  • Bikkoa reserves the right to not admit or to remove users whose data is false, incorrect, or incomplete.

  • Bikkoa reserves the right to cancel or reject any order from a Customer with whom there is a conflict related to the payment of a previous order or that appears to present any type of risk.

  • Bikkoa reserves the right to modify the prices of its products. The purchase price will be the current one at the time the transaction is completed.

  • BIKKOA reserves the right to verify the personal information provided by the customer and take the necessary measures to confirm that the registered person is the holder of the documents or cards used for payment. This verification may take the form of a request for proof of identity and/or address and/or bank documents. If the customer does not respond to such a request within two days of it being made, the relevant order will be automatically canceled, with no possibility of later claim.

  • BIKKOA reserves the right to deactivate those who misuse or abuse the system, commit fraudulent acts, or harm other users. If BIKKOA or any entity professionally linked to it detects any anomaly or suspects that a user is disrupting the normal operation of the system by illegally altering its records through any technical or computer procedure, or carrying out any fraudulent acts that violate its transparency, it reserves the right to deactivate and withdraw benefits that may have been obtained automatically and without explanation from all users who have directly or indirectly benefited from such fraudulent actions, and may also take any civil or criminal actions that may apply. In this regard, BIKKOA declares that it has enabled appropriate technological mechanisms and supports to detect any possible fraudulent, anomalous, or malicious actions intended to alter the registration and proceed on this site.

BIKKOA reserves the right to modify these General Conditions at any time by properly notifying users through the website. The terms and conditions applicable to the transaction will be those in effect at the time the transaction is finalized.

Acceptance of Terms and Applicable Jurisdiction

Registering with BIKKOA implies full acceptance of these terms. All disputes arising from the application of these conditions will be resolved in the courts with jurisdiction according to the consumer's location.
